INTRODUCTION 

These Mobile Wallet Terms and Conditions ("Terms") apply when you add or keep any eligible Meridian debit card ("Card") issued by Meridian Credit Union Limited (“Meridian”, “we”, “us” or “our”) in a mobile wallet ("Mobile Wallet") for use on any eligible device ("Device") that supports the use of the Mobile Wallet.

Please read these Terms carefully. If you add or activate your Card for use in a Mobile Wallet, it means that you accept and agree to these Terms. In these Terms, "you" and "your" means a Meridian debit card holder.

APPLICABILITY OF THESE TERMS 

These Terms are in addition to, and supplement, the agreement that governs the account related to this Card (“Related Account”) as well as any other agreements between Meridian and you regarding Meridian's products and services. If there is any conflict or inconsistency between these Terms and the other agreements, these Terms will take priority and govern with respect to the Mobile Wallet service.

You understand that your use of your Card in the Mobile Wallet will also be subject to the agreements, or terms of use and privacy policies with your relevant Mobile Wallet provider, mobile service carrier, wireless companies, and other third parties who are involved in the operation of the Mobile Wallet, services related to the Mobile Wallet, transactions conducted using the Mobile Wallet or provision of Devices, none of whom are related or controlled by Meridian and each a “Service Provider”.

ADDING A CARD 

If you want to add a Card to a Mobile Wallet, you must follow the procedures adopted by the Mobile Wallet provider, any instructions provided by us, and any further procedures the Mobile Wallet provider or we adopt. Only Cards that we indicate are eligible can be added to the Mobile Wallet. Only the individual Member whose name is associated with the Card should add the Card to the Mobile Wallet in their Device. You understand that we may not add a Card to a Wallet if at any time: (i) your Card or Related Account is not in good standing; (ii) your Card or Related Account has been cancelled or suspended; (iii) we cannot authenticate the Card in accordance with our procedures; (iv) we suspect that there may be fraud associated with your Card; (v) we have suspended or terminated your Card’s eligibility for use with a Mobile Wallet.

New or Replacement Card 

If you receive and activate a new or replacement Card, after adding a Card to your Mobile Wallet, the old or existing Card in your Mobile Wallet will not work. Once you have activated a new or replacement Card, this new or replacement Card will have to be added to your Mobile Wallet.

USING THE MOBILE WALLET 

The Mobile Wallet provides you with another method to conduct transactions with your Card. The Mobile Wallet allows you to conduct transactions using a Card that has been added to the Mobile Wallet wherever the Mobile Wallet is accepted. When you use your Card through the Mobile Wallet to transact with a merchant, it is the same as if you used your physical card at a merchant terminal. Mobile Wallets may not be accepted at all the places where your Card is accepted. You may want to consider keeping your physical Card with you to use in the event you cannot make Mobile Wallet transactions.

Mobile Wallet transactions will be reflected on your Related Account transaction history and/or statements. You are responsible for all such transactions and associated charges and fees in accordance with the Related Account agreement.

Applicable Fees 

We do not charge any fees for adding a Card to the Mobile Wallet. Please consult https://www.meridiancu.ca/personal/rates-and-fees/personal-accounts-fees-and-service-charges for any fees or other charges that can be associated when you make transactions with your Card.

Your mobile service carrier or provider, Wallet Provider or other Service Providers may charge you service fees in connection with your use of your Device or the Mobile Wallet.

Maximum Dollar Limit 

Meridian, the Mobile Wallet provider, payment networks and/or merchants may establish transaction limits from time to time with respect to transactions that may be completed using your Card through the Mobile Wallet. As a result, you may be unable to use the Mobile Wallet to complete a transaction that exceeds these limits, even if your Card and Related Account are in good standing.

The transactional limit of your physical Card and the Card in your Wallet is the same and even if your Card and Related Account is in good standing, you may be unable to complete a transaction if you exceed this transactional limit.

Security 

You are responsible for ensuring the safety and security of your username, user ID, passwords, passcodes and any other information (including biometric information) and credentials required for you to access your Device, conduct transactions with your Card using your Mobile Wallet or using Mobile Wallet services (“Credentials”).

You agree to keep your Credentials confidential and secure from all persons. If you share your Credentials or Device with others (including without limitation, by allowing others to enroll their biometric information, set up a passcode on your Device, or otherwise), they may be able to access your Device and the Mobile Wallet to conduct transactions with your Card through the Mobile Wallet and these transactions will be deemed to be authorized by you. They may also be able to access your personal information.

If you get a new Device, you are responsible for ensuring the removal of your Card and other personal information from your prior Device.

You must contact us immediately if your Credentials have been compromised or if your Card and/or Device are lost or stolen. You are required to contact us immediately if there are errors or if you suspect fraud with your Card. We will resolve any potential error or fraudulent purchase, in accordance with the applicable Related Account agreement.

Notifications 

You may receive notifications through your notification system on your Device upon completing transactions using your Card in your Mobile Wallet. You may turn off Notifications at any time by adjusting the settings in the operating system of your Device. If you allow any other person to access your Device, they may be able to access these Notifications. Meridian is not responsible for any failure to provide you with information (including Notifications) through the Mobile Wallet at any time for any reason. You should not rely on Notifications to confirm the details of the transaction. Refer to your Related Account statement to confirm the details of any transaction.

REMOVING, BLOCKING OR SUSPENDING A CARD 

We reserve the right to discontinue offering or supporting any Card enrolled in a Mobile Wallet. We may, at our discretion, also block, suspend, restrict or terminate the use of any otherwise eligible Card from the Mobile Wallet at any time, including if: (i) if we suspect that there may be fraud associated with the use of the Card; (ii) if your Related Account is not in good standing; (iii) if you violate these Terms or your agreements with Meridian; or (iv) applicable laws change.

You may suspend, delete or reactivate a Card from a Mobile Wallet by following the Mobile Wallet provider's procedures for suspension, deletion or reactivation. In certain circumstances, your Card may be suspended or removed from the Mobile Wallet by the Mobile Wallet provider.

Before you sell, give away or dispose of your Device, you must remove your Card from the Mobile Wallet, otherwise the Card may be available to the person who obtains your Device and you will remain responsible for any transactions completed with your Device.

COMMUNICATIONS 

By enrolling your Card in a Mobile Wallet, you agree to receive communications about the use of the Card in the Mobile Wallet, including: (i) emails to the email address you have provided or (ii) SMS text to the mobile number you have provided, both (i) and (ii) in connection with your Member profile and/or Related Account. You agree to update your contact information when it changes by contacting us. You may also contact us if you wish to withdraw your consent to receive these communications but doing so may result in your inability to continue to use your Card in the Mobile Wallet.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY 

For the purpose of this Section, "Meridian" means Meridian Credit Union Limited. and its agents, contractors, and service providers, and each of their respective subsidiaries. The provisions set out in this section shall survive termination of these Terms.

You agree and acknowledge that your use of the Mobile Wallet is at your own risk. Meridian is not responsible for the security, accuracy or any other aspect of the content or function of the Mobile Wallet or for any third party’s products or services provided in connection with the Mobile Wallet. The Mobile Wallet service is provided by the Wallet Provider, and Meridian is not responsible for its use or function. You acknowledge and agree that Meridian makes no representations, warranties or conditions, of any kind, relating to the Mobile Wallet and in particular, Meridian does not warrant: (i) the operability or functionality of the Mobile Wallet or that the Mobile Wallet will be available to complete a transaction; (ii) that any particular merchant will be a participating merchant at which payments with the Mobile Wallet are available; (iii) that the Mobile Wallet will meet your requirements or that the operation of the Mobile Wallet will be uninterrupted or error-free; (iv) the availability or operability of the wireless networks of any Device and (v) the availability and operability of any other third party Service Provider required to complete the Mobile Wallet transaction.

Meridian will have no liability whatsoever in relation to the Mobile Wallet, including without limitation in relation to the sale, distribution or use thereof, or the performance or non-performance of the Mobile Wallet, or any loss, injury or inconvenience you suffer.

LIABILITY FOR LOSS 

You are solely responsible for all transactions made using your Card processed through a Mobile Wallet. You are responsible for the completeness and accuracy of all information you enter into the Mobile Wallet including information relating to the Related Account.

PRIVACY 

By enrolling a Card in the Mobile Wallet, you acknowledge and consent to the collection, use and disclosure of your personal information in relation to the Mobile Wallet service. You acknowledge that Meridian will collect from you and share with their service providers including the Mobile Wallet provider, the network and other Service Providers certain personal information about you to enable you to enroll your Card in the Mobile Wallet and use the Mobile Wallet. Such information includes your name, your email address and information about your Card. You understand and acknowledge that service providers such as the Mobile Wallet provider, the network and other Service Providers will also have access to certain details with respect to Card transactions made using the Wallet. The Mobile Wallet provider may share information reasonably required for such purposes as fraud detection and prevention.

Meridian will only collect, use and disclose your personal information from time to time in accordance with our Privacy Statement which is available on our website at: www.meridiancu.ca/about-meridian/privacy-and-security.

You can withdraw your consent at any time, subject to our legal and contractual requirements; however, if you withdraw your consent this may limit your ability to use Mobile Wallet. If you withdraw your consent, you must immediately remove your Card from your Wallet or Contact Us.

CHANGES TO THESE TERMS 

We may change these Terms, or the Related Agreement associated with the use of your Card. Notice of any change to these Terms or Related Agreement will be provided to you in accordance with your agreements and applicable law. You agree to any changes to these Terms or the Related Agreement associated with the use of your Card by your continued use of your Card with the Wallet. If you do not accept the revised Terms or Related Agreement, you must delete your Card from the Wallet.

CHOICE OF LAW AND JURISDICTION 

These Terms shall be governed and interpreted provincially in accordance with the laws of the province of Ontario and federally with the laws of Canada. You agree to submit to the exclusive jurisdiction of the courts of Ontario, Canada.
